1. Definitions

In these Terms and Conditions, the following definitions apply:

1.1 "Promoter" means MYDAWA Limited, a company incorporated in Kenya, operating the e-commerce health platform accessible at www.mydawa.com and via the MYDAWA mobile application.
1.2 "Insurance Partner" means APA Insurance, the licensed Kenyan insurer underwriting and administering the APA Jamii Plus health insurance policy offered under this Promotion.
1.3 "Promotion" means the "9 for 9" anniversary promotional offer described in these Terms and Conditions, whereby eligible participants may purchase one (1) APA Jamii Plus Cover for KES 9.
1.4 "Cover" means a standard APA Jamii Plus health insurance policy issued by APA Insurance to a successful Claimant pursuant to this Promotion.
1.5 "Drop" means each individual release of Mystery Box Covers on the MYDAWA Platform during the Promotion Period, occurring on Friday 28th March 2026 and Saturday 29th March 2026 at the times designated by the Promoter.
1.6 "Hidden SKU" or "Mystery Box" means the unique, time-limited product listing placed on the MYDAWA Platform at the commencement of each Drop, through which eligible participants may purchase a Cover. Mystery Boxes are not discoverable via the Platform's standard search function and must be located by browsing the Platform.
1.7 "Claimant" means an eligible participant who successfully locates and completes payment for the Hidden SKU during an active Drop.
1.8 "Promotion Period" means 16th March to 5th April 2026, inclusive of all scheduled Drop dates as announced by the Promoter.
1.9 "Platform" means the MYDAWA website (www.mydawa.com) and the MYDAWA mobile application.
1.10 "KES" means Kenya Shillings, the lawful currency of the Republic of Kenya.
1.11 "Policy Documents" means the full terms, conditions, exclusions, and schedule of benefits of the APA Jamii Plus insurance product as issued by APA Insurance.

2. The Promoter & Insurance Partner

2.1 This Promotion is organised and run by MYDAWA Limited. MYDAWA is acting as the distribution and promotional channel for this offer. MYDAWA is not a licensed insurance company or insurance broker.
2.2 The APA Jamii Plus insurance cover offered under this Promotion is underwritten and administered exclusively by APA Insurance, a company licensed and regulated by the Insurance Regulatory Authority (IRA) of Kenya.
2.3 All insurance obligations, claims, policy terms, and cover administration are the sole responsibility of APA Insurance. MYDAWA's role is limited to facilitating access to this offer through the Platform.
2.4 Participants are advised to read the full APA Jamii Plus Policy Documents, which govern the insurance cover and take precedence over any marketing or promotional materials published by MYDAWA in the event of any inconsistency.

3. Eligibility

3.1 To be eligible to participate in this Promotion and purchase a Cover, a participant must:
3.1.a Be a registered account holder on the MYDAWA Platform at the time of the relevant Drop;
3.1.b Be at least eighteen (18) years of age;
3.1.c Be resident in the Republic of Kenya;
3.1.d Have a valid and active payment method registered on the Platform; and
3.1.e Comply with all requirements set out in these Terms and Conditions.
3.2 The following persons are not eligible to participate:
3.2.a Employees, contractors, agents, and immediate family members of MYDAWA Limited and APA Insurance;
3.2.b Any person who has previously claimed a Cover under this Promotion (one Cover per person for the entire Promotion Period); and
3.2.c Any person using automated tools, bots, scripts, or any other technology to gain an unfair advantage in locating or purchasing the Hidden SKU.
3.3 MYDAWA reserves the right to verify the eligibility of any participant at any time and to disqualify any participant who does not meet the eligibility criteria or who is found to have acted in breach of these Terms and Conditions.
ONE COVER PER PERSON — for the entire Promotion Period. A participant who successfully claims a Cover in any Drop is ineligible to claim a further Cover in any subsequent Drop.

4. How the Promotion Works

4.1 The Promotion runs across two (2) scheduled Drops during the Promotion Period: (i) Friday, 28th March 2026, featuring six (6) Covers released in three (3) sub-drops at 9:00 AM, 12:00 PM, and 4:00 PM EAT (two Covers per sub-drop); and (ii) Saturday, 29th March 2026, featuring three (3) Covers released in a single drop at 12:00 PM EAT. Specific Drop times will be announced by the Promoter on the Platform and via official MYDAWA social media channels.
4.2 Prior to each Drop, the Promoter will publish teaser communications on official MYDAWA social media platforms to alert participants that a Mystery Box Drop is imminent. These communications are intended to build awareness and do not reveal the precise location of the Mystery Box on the Platform.
4.3 At the designated Drop time, the Promoter will activate the Hidden SKU on the Platform. The Hidden SKU will be listed at a promotional price of KES 9.
4.4 The Promotion operates on a strict first-come, first-served basis. Once the stated successful purchases have been completed in a given Drop, the Hidden SKU will be deactivated and no further purchases will be possible for that Drop.
4.5 To claim a Cover, an eligible participant must:
4.5.a Be logged into their registered MYDAWA account;
4.5.b Locate the Hidden SKU on the Platform;
4.5.c Add the Hidden SKU to their cart; and
4.5.d Complete payment of KES 9 using MYDAWA Loyalty Points as the payment method, and select the MYDAWA Store as the designated pick-up point at checkout, before the Drop closes.
4.6 A Cover is only confirmed upon successful payment. Adding the Hidden SKU to a cart does not constitute a confirmed claim. MYDAWA accepts no responsibility for failed payments, payment processing delays, or technical issues on the part of the participant's bank or payment provider.
4.7 The Promoter reserves the right to alter the Drop schedule, postpone any Drop, or cancel any Drop in its sole discretion, including where technical difficulties are experienced. Where a Drop is cancelled, MYDAWA will endeavour to communicate this via the Platform and official social media channels.

5. The APA Jamii Plus Cover

5.1 Each successful Claimant will receive one (1) standard APA Jamii Plus health insurance policy, subject to underwriting, the terms, conditions, and exclusions set out in the full APA Jamii Plus Policy Documents.
5.2 Cover Duration: The duration of the Cover obtained under this Promotion is an annual cover. The Promoter and the Insurance Partner will communicate the cover duration clearly to each Claimant upon confirmation of their purchase.
5.3 Upon expiry of the Cover period, the Cover will lapse automatically. There is no automatic renewal of the Cover obtained under this Promotion.
5.4 At or before the expiry of the Cover, the Claimant will be contacted by APA Insurance with information on how to continue their insurance cover. Claimants who choose to take up a full APA Jamii Plus annual policy following expiry of their Promotion Cover may be eligible for the 10% first-year premium discount, subject to the applicable terms and conditions of that separate offer.
5.5 The APA Jamii Plus Cover obtained under this Promotion is subject to all standard underwriting requirements, terms, exclusions, and waiting periods as set out in the APA Jamii Plus Policy Documents. The payment of KES 9 does not waive, modify, or override any standard policy term or exclusion.
5.6 The Promoter makes no representation or warranty as to the suitability of the APA Jamii Plus Cover for any individual participant's needs. Participants are encouraged to read the full Policy Documents and seek independent advice if required.
5.7 The Cover is non-transferable and is issued solely in the name of the Claimant who made the purchase. The Cover may not be sold, gifted, assigned, or otherwise transferred to any third party.

6. Payment & Refunds

6.1 The promotional price for each Cover under this Promotion is KES 9 (Kenya Shillings nine only). This price is inclusive of all applicable taxes.
6.2 Payment must be completed exclusively using MYDAWA Loyalty Points. No other payment method is accepted for this Promotion. A participant must have a sufficient Loyalty Points balance at the time of checkout to complete the purchase.
6.3 The KES 9 promotional payment is strictly non-refundable in all circumstances, including but not limited to:
6.3.a A change of mind by the Claimant after purchase;
6.3.b Failure by the Claimant to activate, register, or utilise the Cover;
6.3.c Dissatisfaction with the terms or scope of the APA Jamii Plus Cover; or
6.3.d Any dispute between the Claimant and APA Insurance regarding a claim under the Cover.
6.4 Notwithstanding Clause 6.3, where a technical error on the part of MYDAWA results in a duplicate charge to a participant, MYDAWA will process a refund of the duplicate amount within fourteen (14) business days of the error being confirmed.

7. Cover Activation & Registration

7.1 Following a successful purchase, the Claimant will receive a confirmation notification via the Platform and/or the registered email address or phone number on their MYDAWA account.
7.2 The Claimant may be required to complete an APA Insurance registration or onboarding process to activate the Cover. Details of this process will be communicated by APA Insurance directly to the Claimant following purchase.
7.3 MYDAWA accepts no responsibility for delays in activation caused by the Claimant's failure to provide accurate information, failure to complete the APA Insurance onboarding process, or delays attributable to APA Insurance's internal processes.
7.4 The Cover is subject to APA Insurance's standard underwriting and acceptance process. In the unlikely event that a Claimant does not meet APA Insurance's underwriting requirements, APA Insurance reserves the right to decline to issue the Cover. In such circumstances, the KES 9 payment will be refunded to the Claimant within fourteen (14) business days.

8. Making a Claim Under the Cover

8.1 All claims under the APA Jamii Plus Cover must be made directly to APA Insurance in accordance with the claims procedure set out in the APA Jamii Plus Policy Documents.
8.2 MYDAWA has no role in the assessment, processing, or settlement of any insurance claim under the Cover. Any queries or disputes relating to claims must be directed to APA Insurance.
8.3 APA Insurance's contact details for claims will be provided in the Policy Documents issued to the Claimant upon activation of the Cover.
8.4 MYDAWA shall not be liable for any claim refused, disputed, or partially settled by APA Insurance under the terms of the APA Jamii Plus policy.

9. General Conduct & Fair Play

9.1 The Promotion is intended to be a fair and accessible opportunity for all eligible MYDAWA customers. MYDAWA reserves the right to disqualify any participant who:
9.1.a Uses automated scripts, bots, or any technology to gain an unfair advantage in locating or purchasing the Hidden SKU;
9.1.b Creates multiple MYDAWA accounts to circumvent the one-Cover-per-person rule;
9.1.c Uses another person's MYDAWA account without their knowledge or consent;
9.1.d Engages in any fraudulent, deceptive, or dishonest conduct in connection with the Promotion; or
9.1.e Acts in any manner that is abusive, threatening, or harmful towards MYDAWA staff or other participants.
9.2 MYDAWA's decision on any matter relating to the conduct of this Promotion, including eligibility and disqualification, is final and binding.
9.3 No correspondence will be entered into regarding MYDAWA's exercise of its discretion under this clause.

10. Limitation of Liability

10.1 To the fullest extent permitted by applicable Kenyan law, MYDAWA shall not be liable for:
10.1.a Any failure, interruption, or technical malfunction of the Platform that prevents a participant from accessing or completing a purchase of the Hidden SKU;
10.1.b Any loss suffered by a participant as a result of not successfully locating or purchasing the Hidden SKU during a Drop;
10.1.c Any loss, claim, or liability arising from or in connection with the APA Jamii Plus insurance cover, including any refused or disputed claim;
10.1.d Any indirect, consequential, or special loss arising out of or in connection with this Promotion; or
10.1.e Any personal data breach that is directly attributable to APA Insurance's systems or processes.
10.2 Nothing in these Terms and Conditions excludes or limits MYDAWA's liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable Kenyan law.

11. Data Protection & Privacy

11.1 By participating in this Promotion, participants acknowledge that their personal data (including name, contact details, and payment information) will be processed by MYDAWA in accordance with the MYDAWA Privacy Policy, available at www.mydawa.com/privacy.
11.2 Personal data collected in connection with this Promotion will be shared with APA Insurance for the purpose of issuing and administering the Cover. By participating, the participant consents to this sharing of data.
11.3 MYDAWA and APA Insurance will handle all personal data in compliance with the Kenya Data Protection Act, 2019.
11.4 Participants have the right to access, correct, and request deletion of their personal data in accordance with the Data Protection Act, 2019. Requests should be directed to privacy@mydawa.com.

12. General Provisions

12.1 These Terms and Conditions, together with the APA Jamii Plus Policy Documents and the MYDAWA Privacy Policy, constitute the entire agreement between the participant and MYDAWA in relation to this Promotion.
12.2 These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or in connection with this Promotion shall be subject to the exclusive jurisdiction of the courts of Kenya.
12.3 MYDAWA reserves the right to amend, suspend, or terminate this Promotion at any time in its sole discretion, including where circumstances arise that are outside MYDAWA's reasonable control. Any material changes will be communicated via the Platform and official MYDAWA social media channels.
12.4 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
12.5 MYDAWA's failure to enforce any right under these Terms and Conditions shall not constitute a waiver of that right.
12.6 These Terms and Conditions are published in English. In the event of any conflict between an English version and any translated version, the English version shall prevail.

13.3 If a participant has a complaint about this Promotion that cannot be resolved by MYDAWA's customer service team, the participant may escalate the matter to the Competition Authority of Kenya (CAK) or, in relation to the insurance cover, the Insurance Regulatory Authority (IRA) of Kenya.
